| 概要 | Based on the practice of using cases in the mediation of intellectual property disputes, this commentary examines and analyzes the role of cases in judicial mediation. It emphasizes that the reasons why cases can play a role in judicial mediation are that judicial mediation has, in terms of procedures, a close connection with adjudication, and the goal pursued by the parties is correct resolution in law. Compared with abstract legal provisions, cases provide more specific and clear guidance and can, therefore, improve the efficiency of dispute resolution, save litigation costs, and safeguard the fairness of mediation. |
